In re Marriage of Colleen P. Seffren (No. 1-04-3775)

Visitation was denied by a permanent injunction without an evidentiary hearing.  The Appellate Court reversed in part.

Facts:
Former husband filed a motion to suspend former wife’s visitation, add former wife’s cohabitant as a third-party respondent and permanently enjoin cohabitant from havind any contact with the parties’ children or from residing in the former wife’s home.

Findings:
The Circuit court acted within its discretion in post-decree child custody proceeding incident to dissolution of marriage, in adding former wife’s cohabitant as third-party respondent.

Former wife’s cohabitant, subject of former husband’s petition for permanent injunction, was entitled to evidentiary hearing prior to issuance of injunction permanently enjoining him from having any contact with former wife’s children or from residing in former wife’s home.
